APPLICANT REQUESTS THAT:
Her Retention/Retirement Year Ending (RYE) in 2002 be credited
with additional retirement points to reflect a satisfactory year
toward retirement.
APPLICANT CONTENDS THAT:
Had the Air Reserve Personnel Center (ARPC) not violated
Department of Defense Instruction (DoDI) 1215.07 in 2002, she
would have known that she was going to be a few days short and her
participation record would not reflect a bad year.
She left active duty in Jan 01 and was transferred to the
Individual Ready Reserve (IRR). In Dec 01, she joined the Air
National Guard (ANG). For over three years her R/R anniversary
was December; however, in 2004, her point summary reflected a bad
year from 2002. In 2005, she was told that ARPC was behind in
updating files and hers had just been updated. She should not be
penalized because ARPC was behind in their update.
She flew from Arizona to Missouri for five months, coming in the
day before the drill weekend and leaving the day after. If she
had been credited with the points for those days, those days could
have been used to make up for the missing points.
In support of her appeal, the applicant provides copies of e-mail
communiques, her Reserve Point Service History(s), ANG Appointment
orders, Oath of Office, DD Form 214, Certificate of Release or
Discharge from Active Duty, issued in conjunction with her 3 Jan
01 separation and various other documents associated with her
request..

STATEMENT OF FACTS:
During the RYE 11 Jun 02, the applicant was credited with
five active duty points, 24 Inactive Duty Training (IDT) points,
15 membership points, totaling 44 points and an unsatisfactory
retirement year.
AIR FORCE EVALUATION:
ARPC/DPTS recommends approval stating, in part, that the applicant
apparently based her participation in her first year of Reserve
service on a Military Personnel Data System (MilPDS) generated
document with a Dec 10 R/R anniversary date. In fact, she
achieved a year of satisfactory service that year. However, she
did not realize that her correct R/R anniversary date was Jun
12 until advised by ARPC.
On 25 Oct 12, the ARPC Points Branch Chief informed the applicant
that her R/R anniversary year was set automatically in the MilPDS
to 10 Dec pending review by the ARPC Points Branch.
Points technicians subsequently audited the applicant's service
history and correctly set her anniversary year to 12 June--her
first time in active status per DoDI 1215.7, paragraph 6. 1.2.2.
This record adjustment realigned the applicant's participation
points and led to an unsatisfactory year of service.
Nevertheless, prior to the manual audit, MilPDS reflected 10 Dec
as the applicant's anniversary date and she proceeded with her
Reserve participation using 10 Dec as the start counting date for
crediting points and service for retirement. Since ARPC is not
authorized to award participation points or realign service to
make her record whole, the applicant's best course of action was
to appeal to the Board for relief.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 8 Nov 13 for review and comment within 30 days. As of this
date, no response has been received by this office (Exhibit C).
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Having carefully reviewed this application, we agree with the
recommendation of the Air Force office of primary responsibility
and adopt the rationale expressed as the basis for our decision
that the applicant has been the victim of either an error or an
injustice. Therefore, we recommend the applicants records be
corrected to show that she was credited with an additional six
(6) non-paid IDT points resulting in 50 total retirement point;
and that this period was a year of satisfactory Federal service.
Accordingly, we recommend the applicants records be corrected as
indicated below.
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to the APPLICANT be corrected to show that for Retirement
Year Ending 11 Jun 02 she was credited with an additional six
(6) non-paid inactive duty training (IDT) points resulting in
50 total retirement points; and, this period was a year of
satisfactory Federal service.
